Radios.com.br and Radiosnet (Willians Spineli Venga e Cia Ltda ME) appreciates the transparency regarding our users. In this document we explain the manner we collect and process personal data, doing so fully according to the law, respecting your rights to the fullest, and enabling you to use our platform freely.

If you just want to enjoy our broad catalog of radios and store your favorite ones with ease, you are a listener. If you are an owner of any of the radios in our catalog, or if you want to become our partner and disclose your radio on our platform, or even if you want to get to know our services better, we are at your disposal to help you in the best fashion.

LISTENER'S DATA

  • We do not collect any sensitive data from our users and all the data we collect are just those necessary to render our services to you;
  • By messaging us, we collect your contact data, such as your full name, e-mail address, and the content of your message so we can answer your questions most efficiently;
  • By accessing our platforms, your IP data will also be collected with the sole purpose of statistics of the number of listeners. These data are also linked to your access, therefore enabling its tracking to prevent and solve possible fraud attempts to our provision of services.
  • If you want to include, exclude or modify the data of a station in our catalog, use the respective inclusion, exclusion and update forms to know what data must be collected.

 

APPLICANT'S DATA

  • By requesting the inclusion of your radio in our catalog and to increase your visibility on our app and website, we collect your name, city, state, IP address, and device model. Such a collection has the sole purpose of preventing fraud and protecting the platform, the radio, and its users.
  • The inclusion of new radios is performed with the collection of the applicant's name and the Corporate Taxpayer ID Number;
  • We use the G-mail and UOL mail servers to collect the information above;
  • We also perform the targeting to Gerencianet, a company that collects data at the moment of purchase of one of our plants in an entirely safe fashion. At such a moment, your consent will again be requested to perform such an acquisition.
  • In any payment, we will collect data such as the payer's name, the Corporate Taxpayer Identification Number (CNPJ), and the Individual Taxpayer Identification Number (CPF) with the sole purpose of issuing an electronic invoice to the buyer.

DATA COLLECTED ON RADIOS.COM.BR WEBSITE

If you want to surf freely through our website, we automatically collect some specific data at the moment of your access to our platform. Such as the tracking (geolocation), usage data, full name, e-mail, e-mail, and data collected through the demands and needs of our partner platforms, according to what is described in this Privacy Policy.

 

DATA COLLECTED IN THE RADIOSNET APP

If you want to get access to our services through our app, we will need to collect some information besides those above. In this sense, we also collect your device identification with the purpose of advertisement (ID or IDFA from Google Advertiser, according to the session below), purchase history, Universal Unique Identifier (UUID), failure data, device information, and data shared during the use of our services.

We share the data with the following platforms: Cloudflare, Google AdMob, Google AdSense, Google Analytics, Google Analytics for Firebase, Google Play Services, Google Play Store, Firebase Analytics, Firebase Authentication, Firebase Crash Reporting, Firebase Remote Config, Facebook Analytics, Facebook Authentication, Facebook Like Button and social widgets, Google Gmail, Uol Mail, and Gerencianet.

The link of your data to these platforms respects your right to privacy according to this policy, as well as the privacy policy of each of these partners, the Brazilian Law for Personal Data Protection (LGPD), and the European General Data Protection Regulation (GDPR), complying with the purpose presented hereby.

 

1. GOOGLE

Users who sign in via Google

By deciding to link your registration through the Google platform, you agree to make your google account's data available to Radiosnet, such as your e-mail address, full name, and the exclusive navigation identifiers.
We will not have access to your password or other confidential data. You can check what data are shared between our platform and Google by checking the "DATA SHARING - GOOGLE" section below.

 

International Data Transfer to Google

We use applications in partnership with Google, which in turn is headquartered in Mountain View, California, USA. Google's Privacy Policy is in full compliance with international data protection standards and, as you can read in the section above, provides and evidence of compliance with the principles, the rights of the data subject, and the data protection regime that is also provided for under Brazilian law.

The vast majority of our data is stored on servers located in the United States and observes the retention and deletion policy described in the topics "RETENTION PERIOD" and "DATA ELIMINATION".

 

Data Sharing - Google

We use apps in partnership with Google to improve your experience on our platforms. Radiosnet does not have access to your Google account password or other confidential data arising from other platforms. 

However, we make some data available through our platforms about your browsing through cookies integrated with Google linked to your browser, app, or device.

This data is unique anonymous identifiers that are used to generate ads through our App based on your browsing preferences on the Google platform and through our applications. These identifiers are handled by the Google platform for various purposes, especially fraud detection, synchronizing services such as your email inbox, remembering your preferences, and showing you personalized ads. 

Announcements are made based on the following activities:

  • words you search for;
  • videos you watch
  • viewing and interactions with content and ads;
  • voice and audio information when you use audio features;
  • purchasing activity;
  • people you communicate with or share content with;
  • activity on third-party websites and apps that use Google services;
  • Chrome browsing history that you have synchronized with your Google Account;

We do not retain your google account data above on our platforms after the time of sharing. If you have any questions about how your data is handled, feel free to contact us.

 

2. FACEBOOK

Users who sign in via Facebook

You can also use your Facebook account to log in to our platforms. Radiosnet does not have access to your Facebook registration password or other confidential data from other platforms.

The tools we use from Facebook, through the Analytics extension, play the role of reporting graphs and performance from our platforms so that we can analyze our performance in terms of statistics of visits and the most accessed screen by the listener. 

This sharing of data has the purpose of improving the provision of services, being of legitimate interest to the platform so that new content is brought efficiently.

 

International Data Transfer to Facebook

By accepting signing in through your Facebook account, you consent to the data sharing with the Meta Platforms Inc. company, with its head office at Menlo Park, California.

The information is also used to provide, customize, and improve the products based on your consent.

Data Sharing - Facebook

The data sharing with the Facebook platform, through your consent, is linked to your identity as a user and also keeps track of your IP address. This data enables tracking and is processed for targeted advertising. Thus, when you use other services that are also linked to the Meta platform, the advertising mechanisms will be designed based on what suits you best.

We do not retain statistical and advertising data on our platform. Radiosnet only retains your browsing data and preferences made within our platforms, not receiving automated data from third parties.

This sharing has the purpose of improving the provision of services, being of the legitimate interest of the platform for new content to be brought efficiently.

 

3. DATA SYNCHRONIZATION

We will synchronize the data of your account. There will be sharing, specifically, for synchronization of your favorite radio station preferences in the app and on the website. This synchronization is automatically done every time you turn on your device and during the night. You can still manually request immediate synchronization within the application, which will immediately share the data, passing it on to the platform used for registration.

 

4. DATA TO JOIN A MEMBERSHIP PLAN

I want to subscribe to one of Radiosnet's plans. What data do you collect?

If you are a radio owner and wish to join one of our plans to increase visibility on our platforms, we collect some data through your consent so that we can perform the necessary procedures.

  • By filling out a form, you will provide information such as your name, e-mail address, city and state, and IP address. This data is collected using the Gmail and UOL Mail platforms, whose privacy policies can be accessed at the following links: https://email.uol.com.br/paginas-de-ajuda/sobre/politica-de-privacidade.jhtm and https://policies.google.com/technologies/product-privacy?hl=pt-BR. You can also check the summary of this data treatment below in our privacy policy.
  • To effectively subscribe to the plan, you must choose one from the list that best meets your objectives and you will be directed to the site of the company Gerencianet, one of our partner environments that also complies with all the measures to keep your data informed and safe.
  • The data are: name, email, Natural Persons Registration Number, ZIP Code and address. This information is collected so that we can issue invoice regarding the services provided.
  • As a legal requirement, we will issue the invoice relating to the contracted plan and, therefore, we will collect and retain the name of your company and your Corporate Tax Payer Number.

 

5. MODIFICATION OF THE STATIONS' DATA

I want to request a change in one of the radio stations. What should I inform?

If you consider that any information regarding your station is in need of correction, you will need to inform us the identification code (ID) of your radio station. This data will be used to properly complete the update form.

You agree to provide this information through the procedure described on our website, knowing that the information will be fixed as requested and will be retained based on our legitimate interest in presenting the station to listeners.

The radio ID is public information, so we will not violate any privacy rights.

6. DATA FOR REQUESTS

I think one of the Stations has been violating my copyrights. What should I report?

Radiosnet is committed to protecting copyrights and wants to assist you in preventing violations against your rights. In this sense, our platforms must not, in any circumstance, be used for the purpose of infringing laws on this subject, in particular the Intellectual Property Law and the Digital Millennium Copyright Act (DMCA).

If you notice any violations of your copyright, please contact us through the email address: [email protected]. The following data will be collected: your first and last name, e-mail, ID, access device and, at the end, you will have to write a message that sustains your complaint. We suggest that some proof of your authorship is attached to the message so that we can make a thorough analysis.

The data informed will be processed to the extent necessary for us to analyze your legitimacy as author and to check the information of the possible infringer. In this sense, this treatment will fully comply with the guidelines and purposes of compliance with legal obligation, since, according to the law, we need to verify the veracity of all information to ensure the royalties and moral rights due to the authors of the contents transmitted.

 

What data do we collect when you contact us?

When you contact us via email, some data is collected so that we can read the message and properly respond. Thus, by sending the e-mail, you are agreeing to provide us access to the following data: your name, e-mail address, the IP address and device model used at the time of sending.

 

What is the information needed to register?

When you register on our platforms, we collect your IP address. This data has the sole purpose of ensuring that there is no fraud, allowing the proper execution of the services offered without any risk to the user. This data is not shared with third parties before its anonymization process.

After the anti-fraud check, we will anonymize the IP data so that you cannot be identified directly by it. Only then do we share this information with our radio partners, for the sole purpose of providing them with statistics on the number of listeners, so that they can produce content based on this information. We do not disclose this data for any kind of sharing with third parties without anonymizing such data.

 

I want Radiosnet to include a new station to their catalog. What should I inform them?

If you notice that a radio station of your interest is not yet available in out catalog, you may contact us as demonstrated in our Terms of Use.

To do so, you must inform us the following data: type of radio station (AM/FM or Web radio), name, e-mail, your relation to the radio station (i.e. if you are owner, listener, worker or streaming company), registration e-mail of the station, city, country/province and radio website.

Also, as optional information, you can inform the frequency, slogan, logo, streaming links, segment, and radio contact.

All mandatory data is collected based on the legitimate interest of the service.

 

7. USER'S RIGHTS

As the data holder, you have the right to, at any moment, to request information regarding the processing of your data. To do so, simply send an email with your inquiry to [email protected] using the same registration address.

Thus, Radionet is committed to respond, to the extent of what was requested, with the following information:

  • confirmation as to whether any data has been or is being processed;
  • details on what data has been used and/or shared;
  • correction of incomplete, inaccurate or outdated data.

Can I impede processing of certain data?

For data that is processed with given consent, in accordance with this Privacy Notice, you may at any time refuse consent or revoke consent already given. If you do not give us your assent, we will not collect or process that data.

It is important to know that certain data is important for you to be able to browse freely through our platforms and, therefore, if you do not consent, it is possible that certain services will no longer be available to you.

Since some data is important for the fulfillment of contracts and legal ordinances, not all data is subject to your revocation or denial. Only the data collected on consent basis and that is owned by you, as presented in this Privacy Policy, may be subject to revocation.

We, therefore, maintain the right to process the data necessary for the effective provision of services offered on the platforms, as well as to keep Radiosnet in compliance with legal obligations.

 

I gave my consent before, but now I want to remove my information from the database. What should I do?

If you have given your consent to some type of data and now want to revoke it, you can do so at any time by sending a request through your registered email address to [email protected]. If the collection of data has been carried out merely as a result of your given consent, Radiosnet is committed to remove such information from its database within 5 (five) days.

We emphasize that if the data is necessary for the fulfillment of any contract, to comply with legal obligations, for the regular exercise of rights in judicial, administrative or arbitration proceedings or other circumstances permitted by law and included in this Privacy Policy, Radiosnet will not conduct the removal. Even in this case, however, we are committed to inform you of the impossibility of eliminating the data and its reasons  within the same period of three (3) days.

 

Will the radio stations be able to contact me directly?

No. The registered stations do not have access to the individualized data that allow us to contact our users directly, and it is not possible to identify them. The data is anonymized and, therefore, your information is secure.

 

8. DATA PURPOSE

All data collected is done in respect to the principles of the Brazilian General Data Protection Law (LGPD) and the European General Data Protection Regulation (GDPR). We collect data related to your device, such as IP address, date and time of access, language and device model based on the legitimate interest of providing services. We use this data to improve the platform and allow well-founded statistics to be provided to our team and shared with the radio broadcasters that transmit the stations.

The other cookies and data collected on our platforms through your registration are for the purpose of providing more personalized services based on your preferences, and are shared with our partners in conformity to this Privacy Policy.  For this data collected, we rely on your consent, which can be revoked at any time at your will.

 

9. DATA RETENTION

We process and retain data for different periods depending on what type of data they are and their origin. The term of data retention may vary according to the applied legal provisions, being as follows below:

For processed data based on the fulfillment of a contract between Radiosnet and you, the user, they will be kept until such contract has been completely fulfilled.

Personal data collected for lawful interests of Radiosnet will be kept for as long as necessary to fulfill their purposes. Users can obtain detailed information about Radiosnet’s lawful interests within the pertinent sections of this document or by contacting us through the email [email protected].

Data necessary to meet legal, business or tax obligations oblige us to retain some information for specific purposes, for long periods as required by law.

For personal data collected with your consent, we will keep your data for five (5) years before requesting your further consent for data processing. Any change in the type of data processing will be informed and a new request of your consent will be carried out.

Regarding the data collected by applications in collaboration with Google, its retention management follows the Privacy Policy of that company.

Should you request immediate deletion of all your data retained under your consent for the periods listed above, we follow the removal policy to ensure that all data is securely and completely deleted or retained in a completely anonymized form.

A secure deletion is important to protect both types of users from accidental data loss. Complete deletion of data is a process that takes a maximum of thirty (30) days.

 

Note: We do not retain statistical and advertising data on our platform. Radiosnet only retains your browsing data and preferences collected within our platforms, receiving no automated data from third parties.

 

10. SECURITY MEASURES

In order to ensure the authenticity in the inclusion, update or exclusion of radios registered on our platform, we collect some data directly in the form on their respective pages and, to confirm the veracity of the data and their respective owner, we may request additional information in a later contact made by our team.

 

Anti-Fraud Policy

In order to avoid fraud when registering new radio stations or when changing information in the stations already registered, we request of the applicant:

We may also request from the applicant (for adding new radio or changing information on existing channels) additional data such as IP, geolocation at the time of access, name of the radio as registered before the authorities, Corporate Tax Payer Number (CNPJ) of the radio station, name of the responsible owner and their Natural Persons Register number.

 

Data backup

Data backup is a security measure that remedies the recovery of eventually deleted data.

The recovery of data registered on our platforms is performed by the IP Hosting company through the cloud backup service.

If it is necessary to recover your data, please contact us by email at [email protected] and we will do the intermediation.

 

11. COOKIES POLICY

Our Website Radios.com.br and Radiosnet App use cookies and unique anonymous identifiers to monitor audience, navigation, security and advertising, and users agree to such use by accepting this Privacy Policy.

The Cookies can be classified as described below:

(1) Regarding validity:
  1. Session: these are temporary cookies and they remain until the web page, browser or application is closed. They can be used in e-commerce (so that users can continue browsing and not lose the history of the radio stations listened to, for example), to analyze internet traffic patterns and to provide a better experience with our content by personalizing it for users.
  2. Permanent: they persist even if the browser is closed. They can be used to remember users' login and password information, for example, or to ensure a better user experience between different sessions, and especially to bookmark radios stations.
(2) Regarding ownership:
  1. Our own: are owned by Radios.com.br and RadiosNet App, which have full control over the cookies. 
  2. Third-party Cookies: are owned by third parties, but included in users' devices through sites, applications and services offered by Radios.com.br or RadiosNet App.
(3) Regarding the purpose?
  1. Strictly necessary: essential to allow users to use the websites, applications and services offered by Radios.com.br or RadiosNet App, which could not be properly offered without these Cookies. Generally, they are Session and Our Own Cookies.
  2. Performance: they collect anonymous information on how users use and interact with websites, applications and services offered by the UOL Group, allowing them to recognize their profiles and to count visits and interactions. They are generally Our Own Cookies.
  3. Functionality: they allow the Radios.com.br or RadiosNet APP to remember choices made by users (such as login and favorite radio stations) and to provide more personal experiences, besides allowing eventual customizations (when they are available). This information may be anonymized (becoming Anonymized Data) and does not track activities outside the sites, applications and services offered by the UOL Group. They are generally Our Own and Permanent.
  4. Analytical and Advertising: they allow Radios.com.br and RadiosNet App advertisers to deliver more relevant ads and information to users. They are also used to limit the number of times users view certain advertisements and to measure the effectiveness of advertising campaigns. They remember certain user preferences and are used to help map their profile in order to improve user experience. They are generally Permanent and may be from Third Parties (such as Google Analytics, as mentioned below).
  5. Social Media: allow the user to connect with social media, such as Twitter, Facebook, Instagram and YouTube. They are usually permanent and from Third Parties.
  6. Security: helps Radios.com.br and RadiosNet APP to monitor fraudulent activities and protect user data from unauthorized access. They are generally Permanent and Third Party.

The user has the option of not accepting Cookies to navigate through the websites, applications and services provided by Radios.com.br and RadiosNet App, but in these situations Radios.com.br and RadiosNet App cannot guarantee the correct functioning of these websites, applications and services provided. Cookies can be accepted, excluded or rejected through management tools in the browser chosen by the user.

Radios.com.br and RadiosNet App use Google Analytics and Google ReCaptcha to collect and process data, according to Google's Privacy Policy and Terms of Service.

 

12. MODIFICATIONS IN THE PRIVACY POLICY

We may revise this Privacy Policy from time to time. The most current version of our Policy will govern our processing of your personal data and will always be available on our website at the following address radiosnet.com.br/privacy. Should there be any substantial changes to this document, we will keep you informed through our website as well as on our mobile applications for both iOS and Android. We will also send an informational email to your email address linked to your account to inform you and to let you know if you accept and agree to comply with the new version of our Privacy Policy.
